1. About these Terms

These Terms of Use ("Terms") govern your access to and use of phant.ca, including the public Landing, Canada Adult-Use, and International Medical sections (together, the "Site"). The Site is operated by Phant, a brand of Canadian National Pharma Group (CNPG), a company incorporated in Canada.

The Site does not include the authenticated retail portal at phant.ca/retail, which has its own terms accepted at sign-up.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who the Site is for

The Site is intended for the following audiences:

Canada Adult-Use site (phant.ca/canada): Canadian adult-use cannabis consumers of legal cannabis age in their province (18 in Alberta, 21 in Quebec, and 19 in all other provinces and territories), and licensed Canadian retailers.
International Medical site (phant.ca/medical): patients researching cannabis-based medicines, prescribing clinicians, pharmacists, licensed medical distributors, and procurement teams operating in jurisdictions where Phant products are lawfully available through medical channels.
Landing page (phant.ca): all visitors, for the purpose of selecting the appropriate destination.

The Site is not intended for:

Anyone under the legal age of majority in their jurisdiction.
Patient self-referral. The Medical site provides general information; it does not constitute medical advice and is not a substitute for consultation with a qualified healthcare professional in your country.
Recreational use of the products described on the Medical site.
Visitors in jurisdictions where the products described on the Site are not lawfully available.

3. Age verification

Both the Canada and Medical sections of the Site display an age-confirmation interstitial on first visit. By proceeding past the interstitial, you confirm that you are of the legal age of majority in your jurisdiction and that you meet the audience criteria set out in Section 2.

If you are not of the legal age of majority, please leave the Site.

4. Nature of the information on the Site

4.1 General information only

The information on the Site is provided for general informational purposes. It is accurate to the best of our knowledge at the time of publication but is not a comprehensive statement of any subject covered.

4.2 Medical information

The Medical site contains information about cannabis-based medicines manufactured by Phant. This information is intended to support healthcare professionals in their clinical decisions and to inform patients researching what is being prescribed to them. It does not constitute medical advice. Phant does not prescribe, does not provide clinical recommendations, and does not refer patients to specific clinicians, pharmacies, or distributors.

If you are considering a cannabis-based medicine, please speak to a qualified healthcare professional in your country who is registered to prescribe in your jurisdiction.

4.3 Product information

Product specifications, cannabinoid content, and Certificate of Analysis data are accurate per release for the batch they describe. Other batches of the same product may have different cannabinoid and terpene profiles within the specifications stated. Phant reserves the right to update product information without prior notice.

4.4 No promise of availability

Inclusion of a product on the Site does not constitute an offer to supply. Phant supplies its products only through licensed medical distributors (international) and licensed retailers (Canada). Availability varies by jurisdiction and is subject to regulatory authorisation in each market.

5. Permitted use

You may use the Site for the following purposes:

To learn about Phant and its products.
To submit an enquiry through one of the forms provided on the Site.
To request documentation (Certificates of Analysis, prescriber briefs) where you are eligible to receive it.
To navigate to the appropriate section for your jurisdiction.

You may not:

Use the Site in any way that breaches applicable law or regulation.
Use the Site to facilitate the supply of Phant products outside the licensed medical or retail channels in each market.
Attempt to gain unauthorised access to the Site, the retail portal, or any related systems.
Use any automated system (including scrapers, bots, or crawlers) to access or extract content from the Site, except for legitimate search engine indexing.
Reproduce, copy, or republish any part of the Site for commercial purposes without our prior written consent.
Submit false or misleading information through any form on the Site.

6. Intellectual property

All content on the Site — including text, photography, graphics, logos, the Phant wordmark, and the underlying design — is owned by Phant or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for your personal, non-commercial use, provided you do not modify or remove any copyright, trademark, or other proprietary notices. Any other use requires our prior written consent.

The Phant wordmark is a trademark of Canadian National Pharma Group. Other product names and trademarks referenced on the Site are the property of their respective owners.

7. Forms and submissions

When you submit information through a form on the Site, you confirm that the information you provide is accurate and that you are entitled to provide it. We process information submitted through forms in accordance with our Privacy Policy.

We do not guarantee a response time for any enquiry, but we aim to respond to most enquiries within two business days. Time-sensitive enquiries should be directed to the relevant email address listed on the Site.

8. Third-party content and links

The Site may contain links to third-party websites — for example, to medicines regulators or patient information resources. These links are provided for convenience. Phant does not endorse and is not responsible for the content, privacy practices, or availability of any third-party site.

9. Disclaimers

To the maximum extent permitted by applicable law:

The Site is provided on an "as is" and "as available" basis.
Phant makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of the information on the Site.
Phant does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing on the Site constitutes medical, legal, regulatory, or other professional advice.

These disclaimers do not exclude or limit any liability that cannot lawfully be excluded or limited under the laws of your jurisdiction — for example, liability for death or personal injury caused by negligence under UK law.

10. Limitation of liability

To the maximum extent permitted by applicable law, Phant, CNPG, and their respective affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, even if Phant has been advised of the possibility of such damages.

Where liability cannot lawfully be excluded, Phant's total aggregate liability arising out of or in connection with your use of the Site is limited to the amount paid by you to Phant in the 12 months preceding the claim, or [CURRENCY AMOUNT], whichever is greater.

[COUNSEL] Confirm acceptable liability cap and currency for the principal jurisdictions served (UK, Germany, Czech Republic, South Africa, Australia, Canada). The clause above is a defensible default but exact figure is a commercial decision.

11. Indemnity

You agree to indemnify and hold harmless Phant, CNPG, and their respective affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your misuse of the Site.

12. Suspension and termination

Phant may suspend or terminate your access to the Site at any time, without notice, if it has reason to believe you have breached these Terms or applicable law. Sections of these Terms that by their nature survive termination — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable in that province, without regard to conflict-of-laws principles.

You and Phant agree that the courts of British Columbia, Canada have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of the Site, except where mandatory consumer protection laws of your jurisdiction provide that you may bring proceedings in your local courts.

[COUNSEL] British Columbia confirmed as the governing-law jurisdiction (CNPG operates from Abbotsford, BC). The "mandatory consumer protection" carve-out is necessary for UK and EU consumers under their respective consumer rights regulations — please confirm wording is sufficient.

14. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page indicates when they were last updated. Material changes will be communicated through a notice on the Site at least 30 days before they take effect. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.
